These Terms of Service govern your access to and use of NodeNow VPN, including our website, mobile applications, VPN connectivity service, account features, subscription features, and support services. By creating an account, using the app, connecting to the VPN service, or accessing our website, you agree to these Terms.

1. Acceptance of Terms

By accessing or using any part of the NodeNow service, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the service.

If you are using NodeNow on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

NodeNow provides VPN connectivity and related features, including Smart Mode, node selection, app-based VPN settings, subscription status management, and customer support.

The availability, speed, and performance of the service may vary depending on your location, device, network environment, server load, selected node, and other technical factors outside our control. We do not guarantee specific speeds, specific server availability, or the ability to access any particular website, application, service, region, or content through our VPN.

3. Account Registration and Security

To use most features of NodeNow, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete account information
  • Keep your login credentials confidential and not share them with others
  • Notify us promptly if you become aware of any unauthorized access to your account
  • Take responsibility for all activity that occurs under your account

You must not create accounts using automated methods, false identities, or for the purpose of abuse or circumventing service restrictions.

4. Acceptable Use

You agree to use NodeNow only for lawful purposes and in accordance with applicable laws and regulations in your jurisdiction and in any jurisdiction in which your activity has effect.

You are solely responsible for your own compliance with all applicable laws when using the service. NodeNow does not encourage, endorse, or facilitate any unlawful activity.

5. Prohibited Activities

You must not use NodeNow to:

  • Violate any applicable local, national, or international law or regulation
  • Access, store, distribute, or transmit illegal, harmful, or prohibited content
  • Send spam, phishing messages, fraudulent communications, or unsolicited bulk messages
  • Infringe any copyright, trademark, patent, or other intellectual property rights
  • Perform hacking, credential attacks, network scanning, port scanning, or unauthorized access to any computer system or network
  • Distribute malware, ransomware, spyware, adware, or other malicious software
  • Attack, overload, disrupt, or degrade the performance of our servers, networks, or services (including DDoS attacks)
  • Attempt to evade technical limits, account restrictions, or subscription limits
  • Resell, sublicense, share, or commercially exploit the service without our prior written authorization
  • Share your account credentials with others in a way that exceeds your subscription's permitted device or user limits
  • Use the service in a way that harms, disadvantages, or creates legal or regulatory risk for NodeNow, other users, or third parties

We reserve the right to investigate suspected violations and to take action, including suspension or termination of service, without prior notice.

6. Subscriptions, Payments, and Refunds

Some features of NodeNow require a paid subscription. Subscription details, pricing, billing cycles, and available plans are described in the app and on our website.

Subscriptions are managed through the platform or billing provider used for purchase:

  • Google Play: For purchases made through the Android app distributed on Google Play, payments are processed through Google Play Billing unless an alternative billing option is officially and lawfully provided where permitted by Google Play policy and applicable law. Refunds for Google Play purchases are handled according to Google Play's refund policies.
  • Apple App Store: For purchases made through the iOS app, payments are processed through Apple's in-app purchase system. Refund requests are handled by Apple according to their policies.
  • Other payment methods: Where applicable, other payment methods may be available subject to the terms of the respective payment provider.

Deleting your NodeNow account does not automatically cancel active subscriptions. You must cancel subscriptions through the relevant app store or billing platform to avoid future charges.

7. Service Availability and Changes

We work to provide a reliable and consistent service, but we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to scheduled or unscheduled maintenance, technical issues, infrastructure upgrades, or circumstances beyond our control.

We may at any time modify, limit, suspend, or discontinue any aspect of the service — including specific features, servers, nodes, or regions — for operational, technical, legal, or business reasons. Where reasonably practicable, we will provide advance notice of material changes.

8. User Responsibility

You are solely responsible for your conduct and the content of any data you transmit through the NodeNow service. NodeNow is a connectivity service and does not monitor, control, or take responsibility for the content you access or transmit using the VPN.

You acknowledge that use of a VPN service in certain jurisdictions may be subject to local laws and regulations. It is your responsibility to understand and comply with the laws of your jurisdiction before using the service.

9. Privacy

Your use of NodeNow is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights regarding your personal data.

10. Termination

You may stop using the service and delete your account at any time by following the instructions on our Account Deletion page.

We may suspend or terminate your access to the service, without prior notice or liability, if we have reason to believe that you have:

  • Violated these Terms of Service
  • Engaged in abuse, fraud, or harmful conduct through the service
  • Attempted to evade technical controls or subscription limits
  • Created legal, regulatory, or operational risk for NodeNow or other users

Upon termination, your right to access the service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including limitations of liability and disclaimers.

11. Disclaimer of Warranties

NodeNow is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. We do not guarantee that the service will be suitable for your specific use case or requirements.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NodeNow and its operators, affiliates, employees, and licensors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the event giving rise to the claim, or USD $10, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Changes to These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will update the "Last Updated" date at the top of this page and may notify you through the website, app, or email.

Your continued use of the service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.
